Contract Drafting

We assist our business owner clients with preparing their contracts of employment.  It is a critical document.  Good employees will make a business.  A bad or rogue employee can break a business.  A contract of employment can assist in reducing certain risks.  The risk of an employee starting a competing business, the risk of soliciting your clients, the risk of taking your confidential information and know and using it for their own business are just a few risks that can be dealt with in a contract of employment.

Award employees need to be dealt with carefully.  They have Award entitlements and rights which need to be considered in the drafting of the contract.  Having said that, there are ways of mitigating risks in this area to.  Set off or absorption clauses are important so as the employee cannot claim Award entitlements over and above the wage you are agreeing to pay when that wage is already well above the Award rate of pay.  We can help you get these things right.

Restraints of trade are always a big issue.  They are enforceable if drafted correctly.  You need to get a lawyer to draft them otherwise you run the risk they will be void.  Protect your goodwill in the business by ensuring you have an enforceable restraint of trade clause in your employment contracts.

Consider also social media.  How do you control what an employee says or does on social media about your business or generally how they act on social media?  Does it reflect poorly on your business?  Can you deal with these issues in your employment contracts.
